This privacy policy (“Privacy Policy”) is a legal agreement between you and VideoRequest LLC and its affiliates (“VideoRequest”, “we”, “our”, “us”) for the use of certain VideoRequest websites, systems, software, and services (collectively, the “Application”).

We request personal information from you (including your name, email address, business name, and/or phone number) when you use our services, create an account with us on our Application, submit an inquiry, or purchase a subscription.  We may collect information about your activities on the Application, which may include your personal contacts and recordings of interviews with third parties.

We use your data to provide you with products and services that you request, to improve our products, services, or Application, and to provide you with information on our products and services (you can always opt-out from this).

We will take reasonable measures to secure your data, and we store it on our systems for as long as you have an account for legal reasons.  You can access your data by contacting us using the information below.

If a security breach causes an unauthorized intrusion into our system that materially affects and/or presents a real risk of significant harm to you, then VideoRequest will notify you and required others as soon as possible in accordance with applicable legal requirements

We do not share your data with anyone outside VideoRequest, unless we are required to do so by law or as provided in the full text version of the Privacy Policy.

INTRODUCTION

VideoRequest is an online business platform that allows users to solicit customer interviews and collect customer testimonials.

At VideoRequest, we understand our customers’ needs and expectations for products, services and information is an important part of building an enjoyable, interesting and satisfying long-term relationship.  We have created this Privacy Policy so you can have easy access to information about our privacy practices and how we use the information we may collect.  Personal information for the purposes of this Privacy Policy means information that can be used to personally identify you or is associated with any such information, or personal information that may be defined by the laws of the location where you live.

You acknowledge that this Privacy Policy is part of our Terms of Service (the “Terms of Service”) and by accessing or using the Application you agree to be bound by both this Privacy Policy and the Terms of Service. If you do not agree to abide by both this Privacy Policy and the Terms of Service, you should not use the Application.

WHAT INFORMATION WE COLLECT, AND HOW WE USE THE INFORMATION WE COLLECT

We request information from you (which may include your name, address, business name, telephone number, email address, username, password, and payment information (such as credit card and billing information)) when you:

  • Create an VideoRequest account.
  • Request information from us.
  • Log in to your VideoRequest account.
  • Make a purchase.
  • Send us an email or other correspondence.
  • Use VideoRequest.

The information we collect enables us to:

  • Provide to you the products and services that you request.
  • Allow for use of our Application.
  • Personalize our communications to you.
  • Provide information concerning our services.
  • Inform you about new VideoRequest products and services you may be interested in (you can always opt out of this).

VideoRequest may collect the following additional data automatically through your use of our Application:

  • Data related to the technical behavior and performance of the Application, which allows us to provide service diagnostics and improve our products and services.
  • Technical information from the Application to help us improve your user experience and help troubleshoot any problems you may encounter.
  • VideoRequest routinely records technical information such as IP addresses and browser type and version when the browser or your mobile device contacts VideoRequest servers.  This information is used to  improve your user experience and troubleshoot any problems you may encounter.
  • Information collected is stored on servers, which may be located outside of your country of residence.

VideoRequest may use email to contact you with questions regarding your input.  We use email to answer your online questions to us or requests for information.  We may send email newsletters containing promotions of products and services and news (if you have opted in, where required by law).  Occasionally, we may contact you via email to ask for permission to reprint what you have written or recorded in a video, as a testimonial, for use on our website or in our printed materials.

SHARING INFORMATION WITH OTHERS

As a general rule, we do not sell or share your personal data with anyone outside VideoRequest without your consent, unless we are required to do so by law or as provided in this Privacy Policy.  Under no circumstance does VideoRequest sell or share your personal data with third parties for commercial or marketing purposes.

The following are the limited situations where we may share your personal data:

For Application users and/or VideoRequest customers:

We may share your personal data with trusted third parties that perform business functions (e.g. hosting of our Application, analyzing data or technical monitoring of our systems) or provide services on our behalf (e.g. email marketing services, payment processors, or support services). Specifically, we may share your personal information with the following third parties:

  • ActiveCampaign, a cloud platform that we use to manage customer communications and email marketing. ActiveCampaign’s ability to access your personal information is limited by its data processing addendum: https://www.activecampaign.com/legal/dpa.
  • AssemblyAI, a service that transcribes video testimonials and provides captions for VideoRequest. AssemblyAI’s ability to access your personal information is limited by its privacy policy: https://www.assemblyai.com/legal/privacy-policy/.
  • Chargify, a subscription management software we use to collect and process subscription payments. Chargify’s ability to access your personal information is limited by its privacy policy: https://www.chargify.com/privacy-policy/.
  • GoDaddy, our webhosting provider. GoDaddy’s ability to access your personal information is limited by its data processing addendum: https://www.godaddy.com/legal/agreements/data-processing-addendum.
  • Google, a cloud storage provider where we store our customer’s video testimonials. Google’s ability to access your personal information is limited by its data processing and security terms: https://cloud.google.com/terms/data-processing-terms.
  • Heroku, our VideoRequest hosting platform. Heroku’s ability to access your personal information is limited by its data processing addendum: https://www.salesforce.com/content/dam/web/en_us/www/documents/legal/Agreements/data-processing-addendum.pdf.

All such third parties are required to reasonably safeguard your personal data and only process it in accordance with our instructions, unless you consent to additional processing.

  • Sometimes VideoRequest offers you a service in cooperation with other companies. In such cases, we may exchange your personal data with these companies to allow you to make optimal use of our combined services.
  • Upon the sale or transfer of VideoRequest and/or all or part of its assets, your personal information may be among the items sold or transferred.
  • VideoRequest may share non-personal information publicly and with our partners subject to the user’s consent. We take steps to keep this non-personal information from being associated with specific end users and we require our partners to do the same.

  • We may also disclose your personal information (i) to comply with any court order, law, or legal process, including to respond to any government or regulatory request; (ii) to enforce or apply our Terms of Service and other agreements, and (iii) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of VideoRequest, our customers, or others.

For those Insightpath account holders who provide business contact lists or utilize Application features, as well and VideoRequest contacts:

  • We may process and disclose your contact lists and interview recordings, video testimonials, transcriptions, summaries or excerpts of interviews to users of our customer accounts that are associated with the contact list provided or through which the interview was initiated.
  • Upon the sale or transfer of VideoRequest and/or all or part of its assets, the contact lists, video or voice recordings, transcriptions, summaries or excerpts of these interviews may be among the items sold or transferred.
  • We may also disclose the contents of contact lists or interviews (i) to comply with any court order, law, or legal process, including to respond to any government or regulatory request; (ii) to enforce or apply our Terms of Service and other agreements, and (iii) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of VideoRequest, our customers, or others.

    Third Party Processors 

    Our carefully selected partners and service providers may process personal information about you on our behalf as described below:

    We periodically appoint digital marketing agents to conduct marketing activity on our behalf, such activity may result in the compliant processing of personal information.  Our appointed data processors include:

YOUR ACCESS TO INFORMATION

You can request access to and have the opportunity to modify or delete personal information by contacting us using the information provided herein.  For security reasons, we reserve the right to take steps to authenticate your identity before providing access to any personal data.  Subject to applicable law, we may charge you a small fee to access your personal data.  We will provide an individual access to any personal information we hold about them within 30 days of any request for that information.  Unless it is prohibited by law, we will remove any personal information about an individual from our servers at their request.  Because of the way we maintain certain services, it may take some time before backup copies are erased, and we may retain certain data if we are required to do so for legal reasons.

DATA PRIVACY RIGHTS FOR INDIVIDUALS IN THE EUROPEAN UNION AND/OR THE EUROPEAN ECONOMIC AREA

In addition to your right to certain information contained in this Privacy Policy, pursuant to the General Data Protection Regulation (GDPR) and UK GDPR, you may have the following rights regarding your personal data that we hold if you are a resident of the European Economic Area or United Kingdom:

  • be informed of our intent to transfer your personal information to another country or international organization, the recipients of that information, and where information regarding the applicable privacy safeguards may be obtained;
  • request access to your personal information;
  • request correction of your personal information if it is incorrect;
  • request that we delete or stop processing your personal information under certain circumstances;
  • object to our processing of your personal information under certain circumstances;
  • request that we restrict our processing of your personal information, and where our processing is based on your consent, withdraw that consent (by contacting us using the information provided at the end of this policy) without affecting the lawfulness of processing based on consent before its withdrawal;
  • request that we transmit your personal information either to you or another service provider under certain circumstances (costs may apply);

SECURITY AND RETENTION OF INFORMATION

VideoRequest has servers and offices located in the United States. Your information may be accessed from, transferred to, stored, or processed in the United States.  By using VideoRequest’s services and software, you understand and consent to the collection, storage, processing, and transfer of your information to our facilities in the United States and those third parties with whom we share it as described in this Privacy Policy.

We will make reasonable efforts to ensure that your personal data are properly secured using appropriate technical and organizational measures, so that they are protected against unauthorized or unlawful use, alteration, unauthorized access or disclosure, accidental or wrongful destruction, and loss.  We will retain your information for as long as your account is active or as long as needed to provide you services. Once your account is inactive, we typically will not retain your data for longer than five years.  We may, however, retain and use your information in order to comply with our legal obligations, resolve disputes, prevent abuse, and enforce our agreements.  We do collect and retain “aggregate data,” that is, group data with no personal identifiers, which is used to help us understand how our Services are being used and to improve usability.

PRIVACY OF MINORS

Minors under the age of 16 must obtain their parent or guardian’s permission before using VideoRequest Services.  We do not otherwise knowingly collect personal information from anyone under 18.  If we learn we have collected or received personal information from a minor under 16 without parental consent, we will delete that information.  If you believe we might have any unauthorized information from or about a minor under 16, please contact us at support@Insightpath.io.

VideoRequest may use cookies to deliver content specific to your interests and to improve the convenience and efficiency of your experience when using our products and services.  A cookie is a piece of data stored on the user’s hard drive tied to statistical information about the user.  You can always choose to not accept certain cookies, but you may not be able to use some of the VideoRequest products and services.  VideoRequest may also use web beacons, which are small electronic files, to track certain app statistics, such as recording the popularity of certain content, and verifying system and server integrity.

We use the following cookies on our website:

  • Necessary cookies, which are required to make the website function.For example, they permit website navigation and improve security. These cookies cannot be disabled. Strictly necessary cookies include:
    • Multiple cookies (Google ReCaptcha)  – Used to distinguish between humans and bots.
    • ac_enable_tracking (ActiveCampaign) – Used to detect if the visitor has accepted the marketing category in the cookie banner. This cookie is necessary for GDPR-compliance of the website.
  • Statistic cookies, including cookies employed by Google Analytics, a program that tracks website usage and performance.These services use tracking technologies such as cookies to monitor user interactions and activity.  Google’s ability to use and share information collected by Google Analytics is restricted by Google’s privacy policy:  https://policies.google.com/privacy?hl=en-US.
    • _ga (Google Analytics) – Registers a unique ID that is used to generate statistical data on how the visitor uses the website.
    • _ga_# (Google Analytics) – Used by Google Analytics to collect data on the number of times a user has visited the website as well as
      dates for the first and most recent visit.

  • Preferences cookies, which store user choices and information such as login details. Preference cookies include:
    • stream.estimatedBandwidth (iframe.videodelivery.net) – Used to determine the optimal video quality based on the visitor’s device and network settings.
  • Marketing cookies, which include:
    • prism_# (ActiveCampaign) – This information is used only to provide specific marketing information to the visitor. Information is not shared with anyone but ActiveCampaign, where the information is stored.

We do not track our visitors across third party websites to provide targeted advertising and therefore we do not respond to Do Not Track (DNT) signals.  However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you.  If you are visiting such sites, your internet browser may allow you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.

GOOGLE CALENDAR AND OUTLOOK INTEGRATIONS

Users may opt to integrate VideoRequest with Google Calendar or Microsoft Outlook. Doing so provides VideoRequest with:

  1. The ability to view your calendar to look for time openings that can be selected by your contacts.
  2. Add new items to your calendar when your contacts sign-up for a meeting.
  3. Add new items to your calendar to perform follow-up phone calls to your contacts.
  4. Remove these items from your calendar in the event that the contact cancels.

Users can revoke this right at any time on the Project Schedule page or by sending an email to Support@Insightpath.io.

No data from your calendar will be stored by IVideoRequest systems and this data will not be shared with anyone else. VideoRequest, LLC employees do not have access to your calendar.

SOCIAL MEDIA PLATFORMS AND OTHER WEBSITES

VideoRequest may include social media features in conjunction with its products and services, like links to LinkedIn, Facebook or Twitter pages.  These features may collect information about your IP address and which page you are visiting on our Application, and they may set a cookie to make sure the feature functions properly.  Social media features and widgets are either hosted by a third party or hosted directly on our Application.  We may also maintain presences on social media platforms like Facebook, Twitter, and LinkedIn.  Any information, communications, or materials you submit to us via a social media platform is done at your own risk without any expectation of privacy.  We cannot control the actions of other users of these platforms or the actions of the platforms themselves.  Your interactions with those features and platforms are governed by the privacy policies of the companies that provide them.

NO LIABILITY

You understand that electronic communications may be accessed by unauthorized parties when communicated across the internet, network communications facilities, or other electronic means.  You agree that we are not responsible for any electronic communication and/or any of your data which may be lost, altered, intercepted or stored without authorization during the transmission of any data whatsoever across networks not owned and/or operated by us.  We do not guarantee that your information will not be misused or disclosed to third parties.  We will not have any liability to you for any such misuse or disclosure.

CHANGES TO THIS PRIVACY POLICY

This Privacy Policy may be updated periodically and these changes may affect the way we use your personal information.  We encourage you to periodically review this page to stay informed about how we use your personal data.

CONSENT

By using our products or services, you consent to the collection and use of your information as set forth in this Privacy Policy.  Except as required or allowed by law, we will not use or disclose your personal information for any purpose for which you refuse us consent or later withdraw your consent.  If you withdraw consent, you agree that in spite of this withdrawal we may continue to use the personal information previously provided to us to the extent that we are legally or contractually obligated to do so and to the extent necessary to enforce any contractual obligations you may have to us. You also understand that although you can use our products and services for some purposes without providing us with any personal information, we need personal information about you for some services, including those that involve an ongoing relationship with us.  If you refuse to provide us with the information we require or later withdraw your consent to use and disclose this information, we may no longer be able to provide you with these services.
